The terms that apply when you commission a website from TJ Builds, and when you use this site.
The service
I design, build and launch a website for you for a fixed build fee, agreed after a scoping conversation and confirmed before any work begins. The build fee covers the pages, forms and features agreed in scope; anything added afterwards — new pages, new features, a redesign — is quoted and agreed separately before I start on it. Once live, the site moves onto a monthly care plan covering hosting, security updates, monitoring, backups, and a small monthly allowance of content edits, as set out on the pricing page.
Fees and payment
Half of the build fee is due to start the work, with the remaining half due when the site is live and you're happy with it. Monthly billing begins the day the site goes live and continues until the plan is cancelled. If a monthly payment fails, I'll get in touch before taking any further action — a site is never taken down without warning.
Ownership and intellectual property
Your domain is registered in your name — or, if I register it on your behalf, ownership sits with you from the outset — and I have no rights over it. Once the build fee is paid in full, the website itself — its design, code and content — is yours. The monthly care fee pays for hosting and maintenance, not for any ongoing licence to use the site; you own it throughout, including while you remain on the monthly plan.
Hosting, uptime and maintenance
While your site is on the monthly plan, I host it, monitor it for downtime, apply security updates as they're released, keep automatic backups, and handle small content edits as described on the pricing page. I aim to respond to anything urgent, like an outage, as soon as I'm alerted — usually within a few hours. I don't offer a formal uptime or response-time guarantee; if that level of formality matters for your business, tell me and we can discuss it separately.
Cancellation and handover
The monthly plan runs for a minimum of 12 months, then continues on a rolling basis. Either of us can end it with 3 months’ written notice. When it ends, I export the site and hand over the code and content, and I'll spend reasonable time helping you or your next developer get set up elsewhere. Cancelling the monthly plan never affects your ownership of the site or your domain.
Liability
I carry out the work carefully and to a professional standard, but I can't guarantee a website will be entirely free of bugs, or that it will be online 100% of the time — no hosting provider offers that. My liability to you for any claim arising from this agreement is limited to the fees you've paid me in the 12 months before the claim. I'm not liable for indirect losses — lost profits or lost business, for example — arising from downtime or a defect in the site.
Governing law
These terms are governed by the laws of England and Wales, and any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
